Q: What is the sale process?

A: We use standard Purchase & Sale Agreement for Vacant land forms. Your Realtor can help you write the contract or you can purchase directly from the developer. Lots can be financed, please be sure to provide a Letter of Preapproval from your lender. Closing periods of 60 days or less will be acceptable to the developer. The Earnest Money deposit should be 1% of the purchase price at a minimum. 

Q: Are there CC&R's?

A: Yes, there are Codes, Covenants, and Restrictions on the community. See CC&R’s Click Here. You can also see the Architectural Request Form Click Here.

 

Q: Will there be a continuous fence along the perimeter of the community?

A: Yes, there will be a continuous 6′ fence that will be constructed at homeowners’ expense as homes are built. The developer is currently identifying the standard building material and stain. Homeowners will be responsible for the installation upon completion of their home.

 

Q: Are there entry gates?

A: No, there will not be entry gates. The original plan was for there to be entry gates, but the City of Washougal wanted to turn Magnolia Loop into a one-way road which the developer thought would be unappealing. As such, the developer decided not to install gates.

Q: Is Magnolia Loop a private road?

A: Yes, it is a private road.

Q: Is Waverly Homes building in this community?

A: No, Waverly Homes is the developer but is not building in this community. The lots are for sale to builders and clients. It is a “bring your own builder” community that will offer a great deal of variety of homes being built.

Q: What are the setbacks on the lots?

A: Side setbacks are 5′ and the rear yard setback is 10 feet

Q: What is the maximum lot coverage?

A: The maximum lot coverage is 40%. They do not count flatwork (driveways, walkways, uncovered patios) in that calculation.

Q: Is there a minimum square footage requirement?

A: No, but home plans do have to be approved by the Architectural Review Committee.

Q: What is a Public Offering Statement?

A: A Public Offering statement is a document describing details of the development, future plans related to the development, common elements, anticipated expenses, existing liens and warranties, limitations on use or sale of the units, and many other issues related to construction, use and management of property that is part of the Common Interest Community. The Public Offering Statement is required under the new state law, Washington Unified Common Interest Ownership Act, which affects all HOA communities established after July 1, 2018. Under WUCOIA, an HOA is a Common Interest Community if the CC&R’s (recorded after July 1, 2018) describe both individually owned units and common areas that benefit and are funded by the unit owners.
